影響臺灣民眾司法信任之因素探討

    [中文摘要]
    「法律千條萬條,不如黃金一條」、「有錢判生、無錢判死」、「法律是保護懂法律的人」是台灣民眾間耳熟能詳的司法諺語。中央研究院社會學研究所「台灣社會意向調查」歷次的調查,都呈現民眾對於法官的信任低於醫師或教授的趨勢,同時不信任法院的比例亦呈現越來越高趨勢。上述司法諺語與調查結果凸顯了台灣民眾不信任司法的社會現況。
    本研究為解釋台灣民眾司法信任的因素,使用司法院「101年一般民眾對司法認知調查」資料,以受訪者性別、年齡、教育程度、職業、收入、法律常識程度、有無到法院辦事或打官司的經驗及獲得司法消息或資訊的來源等為自變項,受訪者對法官的信任程度、法院的信任程度為依變項,透過迴歸分析各自變項對依變項的影響。
    研究結果發現,性別、教育程度、職業、法律常識程度、有沒有到法院辦事或打官司的經驗及獲得司法消息或資訊的來源,是影響法官信任的因素;教育程度、職業、法律常識程度、有沒有到法院辦事或打官司的經驗及獲得司法消息或資訊的來源,是影響法院信任的因素。其中,有沒有從社會網絡獲得司法消息與資訊是對法官信任,也是對法院信任影響力最大的因素。

    Taiwan people spread some proverbs that describe the injustice of the judicature. According to the survey of Institute of Sociology, Academia Sinica, many people trust doctors and professors more than judges in Taiwan. Besides, many people distrust the court in Taiwan. These proverbs and surveys present that Taiwan People distrust the Judicature.
    Using the data of “The Survey of Peoples'attitude to the Judicature”, this paper tries to explain the factors that affect the trust in judges and courts of Taiwan People. Using gender, age, level of education, occupation, income, level of general law knowledge, the experience about action, and the way of getting information or news of the Judicature as independent variables, this research attempts to demonstrate whether or not these variables affect the trust in judges and courts of Taiwan People.
    The results show that gender, level of education, occupation, level of general law knowledge, the experience about action, and the way of getting information or news of the Judicature affect the trust in judges of Taiwan People. Level of education, occupation, level of general law knowledge, the experience about action, and the way of getting information or news of the Judicature, affect the trust in courts of Taiwan People. Getting information or news of the Judicature from social network can make maximum effect to the trust in judges and courts.
